Apply online to register your food business
To store, prepare, distribute or sell food on premises in the borough of Basingstoke and Deane you need to be registered with Basingstoke and Deane Borough Council. Food premises include restaurants, hotels, cafes, shops, supermarkets, staff canteens, kitchens in offices, warehouses, guest houses, delivery vehicles, buffet cars on trains, market and other stalls, hot dog and ice cream vans etc.
Article 6 of Regulation (EC) 852/2004 requires food business operators to register their premises with the environmental health department.
The food safety team will check that the application form is properly completed and enter the details on its database. Records of information other than trading name and address provided will not be publicly available.
Making an application
You can apply online to register your new food business through the UK Business Link website. In order for your online application to be accepted you must complete the full application process online and upload your completed application form to the online system. In order to complete the online application process you will require a government gateway registration.

Changes
Once you have registered with the council you only need notify us where there is a change of proprietor, where the nature of the business changes, or where there is a change of the address at which movable premises are kept. The new proprietor will have to complete an application form.

When should I expect a decision?
Tacit Consent applies to this application. All premises will be registered on receipt of a properly completed application form. Anyone starting a new food business must register with us at least 28 days before doing so.

FOOD PREMISES APPROVAL
Not all premises require approval and you are advised to discuss your proposals with the Food and Safety Team before submitting any application.
Certain type of food premises, generally manufacturers of products of animal origin, such as dairies, meat product manufacturers or wholesale fish markets are subject to formal premises approval. This is a requirement of European Community Directive 853/2004.
These types of premises are required by law to be approved by the local authority and generally their products must display a health mark or be accompanied by a health certificate. Each local authority in the country (and places across the EU) has a unique code which ensures that the origin of the food can always be established.
Once approved, details of the premises together with information relating to types of foods produced are forwarded to Food Standards Agency to be kept on a central EU register.

Once you have submitted an application to the council The Food and Safety Team will check that the application form is properly completed and that the premises do require approval. Approval can only be granted following the correct submission of an application form together with other relevant documents. It is necessary for an officer to carry out a detailed inspection of the premises before approval is granted. It may be necessary for an officer to request further information before approval is granted. There is no fee required for a Food Premises Approval application.

When should I expect a decision?
Tacit consent will not apply to this application as this may compromise public health by allowing premises which do not comply with the hygiene regulations to place food on the market.

Changes to approved premises
Please contact the Food Saftey Team if you wish to carry out any additional activities or wish to change the processes that are carried out in the establishment as you may require further approval.
Failed Application Redress

Any food business operator aggrieved by a decision in relation to a granting of approval may appeal to a Magistrates Court within 28 days of a decision being made.
