First decide where and when you wish to trade then contact the licensing team. We recommend that you read our Street Trading Policy before applying as this will advise you on how we approach applications for Street Trading within the Borough. This policy can be downloaded below.
If you wish to sell hot food and drink after 11pm at night, you will also need a premises licence under the Licensing Act 2003. Please search our licensing pages for information using the link in blue to the left of this page.
When you decide that you have found a suitable pitch we suggest you contact the Licensing Team first to discuss the location as there are a few areas that are not suitable for trading.
The following locations have already been considered unsuitable for Street Trading.

ACCESS ROAD TO REAR OF SHOPS AT RETAIL PARK, WALLOP DRIVEWhen you have located a pitch that you would think is suitable and meets with our street trading policy, we recommend that you obtain a map of the location and mark it showing the position of the proposed trading pitch and bring this in to the licensing team to discuss before making an application. We will then assess the location against our street trading policy and consider any other information we may have on the site in terms of its suitability for trading and inform you if we consider the pitch may be suitable.
If it appears that the pitch may be suitable, you will need to complete an application form which can be downloaded by using the link below or you can request a copy from a member of the Licensing team. There is no guarantee at this stage that your application will be successful which is why it is imperative to choose an area that meets our policy requirements. The parties who are consulted (as detailed below) will assist the licensing team in determining the suitability of the location based on their specific knowledge of the area.
Where there is more than on trader at a location there must be an interval of one hour between traders start and finish times to allow sufficient times for traders to clear up after trading before the later trader arrives on site.
If the location is on private land to which the public have access you must also provide evidence that you have the land owners permission.
Please return the completed application form with a non - refundable deposit of a £125 and evidence that you have public liability insurance to the value of £5 million. If you wish to sell food you must also provide evidence that your business is registered with your local Environmental Health Department.
Applications will not be considered without this evidence and incomplete applications will be rejected.
The full fee for 2012/13 is £1010.00. Payment may be made in full or by direct debit over 10 months. Fees can be applied on a pro rata basis for shorter consent periods.
Applications can take up to 2 months to be determined.

What happens next?
If a Consent is granted it will be for a period of one year, or a shorter trial period if appropriate.
All Street Trading Consents are subject to compliance with the Council's Standard Licence Conditions. Click on the link below to download a copy of these, or use the email link at the bottom of the page to request a set.
The Conditions will control trading hours, litter removal, health and safety standards and anything else that the Council determines to be relevant.
What if an application is refused?
Consent may not be granted when relevant adverse comments are received from the consulted parties.
Consent will not be granted where there is a risk to road safety or possibility of a nuisance being created.
If your application is refused you may discuss the application with Licensing Officers. You may request in writing for the Head of Governance to review the decision and if still not satisfied by the decision you may appeal to the Council's Licensing Committee. Other than Judicial Review there is no statutory right of appeal against the Councils decision.
Revocations
The Council may revoke a Street Trading Consent after it has been granted. This may be for a variety of reasons such as non compliance with conditions, non payment or because other agencies such as highways department require access to the trading location. You will be given at least 10 days notice if your Consent is to be revoked.
You may request in writing for the Head Governance to review the decision and if still not satisfied by the decision you may appeal to the Council's Licensing Committee. Other than Judicial Review there is no statutory right of appeal against the Councils decision.
Enforcement Policy

Ice Cream Vans
If you wish to sell ice cream on the street using a street trading consent, you must not to cause a noise nuisance with your chimes and are reminded that under Section 62 of the Control of Pollution Act 1974 it is an offence to sound chimes before 12 noon or after 7.00 pm, and to operate or permit the operation of any loudspeaker of the "ice-cream van chimes" type in the street unless there is no reasonable cause for annoyance to persons in the vicinity.
Seasonal Street Trading (Christmas Trees)
In preparation for the seasonal increase in street traders over the festive period the Licensing Team would like to remind residents and potential traders that it is an offence to trade on the borough streets without the council’s consent. Any person wanting to sell items from a trailer or stall in a street, including the sale of Christmas trees and other seasonal goods, must apply to the Council’s Licensing Team before starting to sell any items. There is a charge of £125 for a temporary consent with an increase fee for longer trading periods (up to 12 months). Please contact the Licensing Team for further information.
