Temporary and occasional events under The Licensing Act 2003

Premises licences are not necessarily needed for small events involving licensable activities where less than 500 people are likely to be in attendance (including staff) and which last no more than 96 hours. These events can be authorised by way of a Temporary Event Notice.

Temporary event notices (TENs) can be given to permit any or all of the following:
  • the sale of alcohol
  • the supply of alcohol to members of a registered club
  • provision of late night refreshment - hot food or hot drink at any time after 23:00 or before 05:00.
  • regulated entertainment.

TENs cannot be at the same premises on more than 12 occasions in any calendar year. In addition, each premises is subject to an overall aggregate of 15 days use, irrespective of the number of individual occasions on which they have been used. There must also be a minimum of 24 hours between events. You must be 18 years or older to give a TEN and can give a maximum of five TENs per year. If you are a personal licence holder, you can give a maximum of 50 TENs per year.

Your event must involve no more than 499 people at any one time . Where the event is likely to attract larger numbers of guests up to 499, we recommend you discuss the event plans with the Licensing team and the Environmental Health team and police in advance for advice. If the premises where the event is to be held is in areas governed by two or more local authorities applications must be made to each.

Licence summary

The notice must be served in a specific format and should contain

  • details of the licensable activities
  • the event period
  • the times when during that period the activities will take place.
Please ensure that you clearly state the timings for each licensable activity using the 24 hour clock. Where an activity extends through until the early hours of the following day both dates should be clearly stated on the notice. Should there be any errors on your TEN it will be deemed invalid and will be rejected.

Application evaluation process

The Licensing team will acknowledge receipt of the notice by giving a notice to the premises user. The chief police officer who receives a notice and believes that the event would undermine crime prevention objectives can serve an objection notice on the licensing authority and the premises user. This notice must be served within 48 hours of receipt of the temporary event notice.

The Temporary Event Notice must be given in writing (including by electronic means) to the local authority at least ten working days before the event.  This does not include the day the notice is received or the day of the event.  Any notices received after that period will not be valid and any licensable activities carried on would be unlawful.

Unless an application has been submitted electronically, the premises user must also give notice to the chief officer of the local police department no later than ten working days before the event period.

The notice must be accompanied by a fee of £21, all cheques made payable to Basingstoke and Deane Borough Council.  The police may issue a counter notice if it considers it necessary for the promotion of crime prevention objective and a hearing must then be held by the Licensing Authority.  A decision must be made at least 24 hours before the beginning of the event.

A police chief may modify the TEN with the consent of the premises user.  In such a case an objection notice will be deemed to have been withdrawn.  Counter notices may be provided by the licensing authority if the number of permitted TEN's has been exceeded.

METHODS FOR SUBMITTING A TEMPORARY EVENT NOTICE

There are two methods of submitting a TEN. The Licensing Team are able to accept applications using method 1 or method 2, not a combination of both. 

If you wish to make an electronic online submission and an electronic payment and are close to the 10 working day submission deadline, you may prefer to use the online application method detailed at option 1 below.

Please note that if you use the online method and payment you cannot then download these forms and submit them as a hard copy. Any forms received this way will be rejected and you may find your proposed event to be authorised by the TEN cannot go ahead due to the delay.

If you prefer to submit your TEN manually to the council offices or by post then please use the 2nd option below by clicking on the link below labelled 'Temporary Event Notice Application form (To be completed by hand)'. Payment can be made by cheque, telephone or online via this website. Please ensure that you allow sufficient time to meet the 10 working day deadline. The 10 working days do not include the date of receipt of the 10 by the council or the day of the proposed event. There must be 10 clear working days in between.



1. Making an Online Application

You can apply and pay for a temporary event notice online through the UK Business Link website. You MUST complete the full application process online and upload your completed application form with supporting documentation to the online system. The relevant payment must also be made online.

Please be aware the application form available to download on the UK Business Link website can NOT be printed off and submitted by post or by hand to the Licensing team.  You must upload the completed form to the system and submit your full application electronically (including payment). In order to complete the online application process you will require a government gateway registration.

2. Making a Manual Application


If you prefer to submit an application by post or by hand to the Licensing team you MUST print off and complete the form below by hand and return to the Licensing team. Applications can also be requested from the Licensing team and sent to you by post.


The notice must be accompanied by a fee of £21, all cheques made payable to Basingstoke and Deane Borough Council. Applications submitted by post or by hand should include two copies of the TEN.  Applicants submitting an application by post or by hand must serve a copy of the notice to the police licensing officer no later than ten working days before the event period.

When should I expect a decision?

Tacit consent applies to this application. This means that you will be able to act as though your application is granted if you have not heard from the Licensing Team within 14 days of your Temporary Event Notice being served.

Failed application redress

Please contact your Licensing team in the first instance.
If a counter notice is given in relation to an objection notice the applicant may appeal against the decision. Appeals must be made to the local Magistrates' court within 21 days. An appeal may not be brought later than five working days from the day of the planned event.

Consumer complaint

We would always advise that in the event of a complaint the first contact is made with the trader by you - preferably in the form a letter (with proof of delivery).  If that has not worked, if you are located in the UK, Consumer Direct will give you advice.  From outside the UK contact the UK European Consumer Centre

Other Redress

If a Licensing team decides not to issue a counter notice in relation to an objection notice the chief police officer can appeal the decision.  Appeals must be made to the local Magistrates' court within 21 days.  An appeal may not be brought later than five working days from the day of the planned event.
