Personal Search Procedures

 Amendment to the Local Land Charges Rules 1977 - Personal Search Fee

The Government has concluded that charging a fee for a personal search of the local land charges register is 
incompatible with the Environmental Information Regulations 2004 (EIR) and the underlying 2003 EU Directive.
Following this conclusion and Government is revoking the current £22 fee by amending the Local Land Charges 
Rules 1977.  The Amendment came into force on 17 August 2010, in light of this decision;  Basingstoke and Deane Borough Council has ceased to charge this fee with immediate affect. You no longer need to book an appointment.                 

• To access the local charges registers, come into the council's reception and use of the available terminals.  Instructions are available with the receptionists.
• This system will be operated on first come first served basis, between the hours of 8.30am and 5pm (4.30pm on a Friday)
• If con29 component data is required, this can be obtained by requesting in writing or by emailing allinlandcharges@basingstoke.gov.uk along with the address and a plan of the property/land in question, please indicate which questions are required.  A cheque made payable to Basingstoke and Deane Borough Council will be required for this service.  Fees are available on the website.  When your fee has been received and component data is ready, we will email this straight back to you.  Please provide an email address if sending in request
  
  As highways agency for the area, Hampshire County Council, The Castle, Winchester (01962 841841) will have
  to be contacted for any information regarding highway adoption.     
   
  Refunds
• No decision has been made about the possibility of refunding fees paid for personal searches, pending further legal advice.
• Should a decision to refund be made these should not be made to the personal search companies, who themselves have already been paid by their clients to undertaken land searches, but direct to the individuals who employed the search companies. This will ensure personal search companies are not unjustly enriched by a refund.
• Any decision to refund will be proportionate to the sum refundable and should represent value for money particularly as regards the cost of administering any refunds.
