Who makes the Decision on a Planning Application?

Development Plans and Planning Guidance

Decisions are made in accordance with the Development Plan unless material consideration say otherwise.

The relevant Development Plan for Basingstoke and Deane are set out in the Basingstoke and Deane Borough Local Plan .

The Council has produced a number of planning and design guides and leaflets on a range of topics to help applicants, agents, designers, developers and Council officers prepare and evaluate development proposals. Due account of these documents will be taken in determining any planning applications.

Consultations Prior to the Determination of a Planning Application

The documents below detail who we will consult on a planning application before making a decision. This includes statutory consultees (those we must consult) and non-statutory consultees.

Most planning applications are dealt with at officer level under a Scheme of Delegation which is contained within Part 4 of the Borough Council's Constitution.  In this circumstance the application will not be reported to the Development Control Committee for determination. In certain circumstances, as set out in the Scheme of Delegation, the application will be determined by the Development Control Committee. Please note that the Constitution sets out that a borough councillor can require an application to be called in to be determined by the Development Control Committee.  This can happen at any time prior to the determination of the application (NB The Constitution states that this 'call in' needs to happen within 21 days of the registration of the application - however this time limit has been removed and the Constitution will be updated in due course).

Approximately 6% of planning applications are determined through the Development Control Committee. Applications are referred to the Development Control Committee when the Head of Planning and Transport considers that the application is ready for determination. It will not be possible to delay the determination of an application due to holiday or other personal commitments. For information on membership of the Committee, dates of meetings and to read agendas and minutes of the meeting click Development Control Committee

Both members and officers are required to act within the Code of Practice which is appended to the Borough Council's Constitution as Appendix 2.
