Licensing Policy 2011 - 2014
Under the Licensing Act 2003 the Licensing Authority is required to produce a Statement of Licensing Policy every three years. The statement of Licensing Policy must set out how the Licensing Authority will carry out its functions under the Act and how it will promote the four Licensing Objectives .
The four objectives are:
Prevention of Crime and Disorder
Prevention of Public Nuisance
Public Safety
Protection of Children from Harm
The council's Statement of Licensing Policy must be approved for implementation by February 2011.
The new government has proposed changes to the Licensing Act 2003 and is currently consulting on those proposals.
Any changes to the Act arising out of that consultation are likely to have an impact on this council's Statement of Licensing Policy. It has therefore been decided to carry out a major review of the Council's Policy after these proposals have been implemented in 2011.
In the meantime, to fulfil the Council's statutory obligations under the Act it has decided to consult on the existing policy in its current format for the period up to February 2011 and consult more widely on a fully reviewed policy in 2011 following any changes to the legislation. The existing policy has worked well to date and has assisted the Licensing Authority in its role under the Act with regard to making licensing decisions.
A copy of the current policy for consultation and a questionnaire are attached below. If you wish to respond, the closing date is 20 October 2010.
