Review of premises licences or club premises certificates under The Licensing Act 2003

Sometimes, activities at licensed premises and clubs can lead to problems. On the rare occasion this happens, the council will try and resolve the issues informally. However, any of the ‘responsible authorities’, or 'interested parties' defined under the Act, can apply for the council to review a licence because of matters arising at the premises in connection with any of the four licensing objectives which are:

  • the prevention of crime and disorder
  • public safety
  • the prevention of public nuisance
  • the protection of children from harm

If the licensing authority considers that action is necessary under its statutory powers, it may take any of the following steps at a review of a licence:

  • modify the conditions of the premises licence, ie: reduce the hours  of opening, or by requiring door supervisors at particular times;
  • exclude a licensable activity from the scope of the licence, for example, exclude the performance of live music or recorded music;
  • remove the designated premises supervisor, for example, because they consider that the problems are the result of poor management;
  • to suspend the license for a period not exceeding three months;
  • to revoke the licence.

On receipt of an application for a review of a licence, interested parties and responsible authorities may make relevant representations in writing for a period of 28 days. The Licensing Authority must advertise the review application at the licensed premises subject to the review, at the Council's offices and on the Council's website.

Responsible authorites and interested parties may comment on this application for a review by writing to the Licensing Team at Basingstoke and Deane Borough Council before 25 December 2008. Any comments recieved after this date cannot be accepted.
