All public authorities listed in Schedule 1A of the Race Relations (Amendments) Act 2000 are subject to a Statutory duty under Section 71 (1) of the Act.
Section 71 (1) of the Act requires public authorities to have “due regard” to the general statutory duty in carrying out their functions. This means giving appropriate weight to:-
- eliminating unlawful discrimination;
- promoting equality of opportunity; and
- promoting good race relations
when carrying out functions and implementing policies.
All listed public authorities are required to review their list of functions, policies and proposed policies for relevance to the general duty every 3 years. The purpose of this specific duty to review this list is to ensure that:
- there are proper arrangements in place for effective implementation of the scheme;
- the scheme is kept up to date and relevant to the business of the organisation.
This is the report of Basingstoke and Deane Borough Council`s Statutory Three Year Review for the period 2002-2005 in accordance with the Race Relations Act. This review has been carried out in consultation with Heads of Service and Business Unit Managers, Strategic Management Team and the Equality and Diversity Working Party. The report outlines the findings of the review. It sets out progress against the Race Equality Scheme Action Plan and updates the Action Plan to take account of new policies, functions, evidence and targets. The new list of functions, policies and proposed policies can be found at Appendix 1.
