Section 179 of the Town and Country Planning Act, 1990

On 22 December 2004 at Winchester Crown Court Mr Shayler pleaded guilty to failing to comply with an Enforcement Notice served on him on 24 February 2003 to either remove a fence or to reduce the height of the fence to two metres or less.

He was given a 12 month conditional discharge and ordered to pay £10,000 costs.

Section 210 and 211 of the Town and Country Planning Act, 1990

In September 2004 Mr N was found guilty of felling trees in a conservation area without giving notice of intent to do so. He was fined £500 and ordered to pay £105 costs.

Mr P was found guilty of aiding, abetting, counselling or procuring Mr N in committing that offence. He was fined £300 and ordered to pay £105 costs
