Alcohol related Public Space Protection Orders (PSPOs)

The Criminal Justice and Police Act 2001 gave local authorities the power to designate places within their area where restrictions on public drinking apply. These powers were introduced to help the police and council deal with the problems of antisocial drinking in public spaces. The orders were called Designated Public Place Orders (DPPOs).

In October 2017, all Designated Public Place Orders still in existence converted to Public Space Protection Orders (PSPOs) with the same conditions under the Antisocial Behaviour, Crime and Policing Act 2014.

These orders make it an offence to drink alcohol after being required by an authorised officer not to do so. Authorised officers (including Community Safety Patrol Officers, Police Community Support Officers and Police Officers) have the power to require individuals to surrender any alcohol in their possession including any opened or sealed containers, and if they fail to comply with the request they commit a criminal offence. This can be used in areas that have previously experienced alcohol-related problems.

Failure to comply with the request of an authorised officer can result in a £75 Fixed Penalty Notice (FPN) or a fine of up to £500 on conviction.

Dog related Public Space Protection Orders (PSPOs)

Stratton Playing Field, Buckskin, Basingstoke and Beggarwood Park, Hatch Warren, Basingstoke, and various locations in Kingsclere are covered by Public Space Protection Orders (PSPOs). This increases the fixed penalty fine for dog fouling to £75 and requires dogs to be kept on a lead when directed to do so by an authorised council officer. Failure to pay a fixed penalty notice may result in a maximum fine of £1000 upon conviction for non-payment.
