Environmental permitting

Businesses whose activities may cause emissions to air, land, or water may need an Environmental Permit under the Environmental Permitting (England and Wales) Regulations 2010.

Do I need a permit

Your business may need an Environmental Permit if your activities could cause emissions to:

  • air
  • land
  • water

Check if you need a permit on the GOV.UK website.

You may also need to:

  • update (vary) your permit if your activity changes
  • transfer it if ownership changes
  • close (surrender) it if the activity stops

Small waste oil burners

Rules have changed for small waste oil burners (SWOBs), such as heaters used in garages. These devices are now covered by the Industrial Emissions Directive (IED) and strict rules apply, including monitoring and reporting.

What this means for you

  • you can no longer burn waste oil in these heaters unless you get an environmental permit, and meet strict operating standards
  • in most cases, this makes using waste oil impractical and costly

What you can still do

  • You can continue to use these heaters with non-waste fuels, such as:
  • kerosene
  • gas oil
  • fuel oil

How to apply

  • To pay online, select Miscellaneous Payments option then chose the appropriate Env Permitting application.

  • There is an annual charge once your permit is issued

Application procedure

Application evaluation process
Checking your application When we receive your application, we first check that it is complete. This is called being ‘duly made’.

The application must include all the information needed for us to make a decision
The decision process (called a determination) does not start until this check is complete. If your application is not complete:
- we will return it to you
- we will explain what is missing
- any fees will be refunded
How long it takes Once your application is duly made, we aim to decide it within:
- A2 applications: 5 months and 3 weeks
- Part B applications: 4 months
- Dry cleaners and small waste oil burners: 3 months

These timescales may be longer if:
- we need more information from you
- there is a confidentiality request
- we need to consult on conditions outside your site
- a longer time is agreed with you
Other application timescales - substantial variations: 4 months
- non-substantial variations: 3 months
- permit transfers: 2 months
- A2 permit surrender: 3 months

Longer timescales may apply if agreed.
Surrendering a Part B permit If you want to stop your activity you must give us at least 20 working days’ notice before the permit ends.
Will tacit consent apply

Failed application redress

We would suggest to contact us in the first instance. If you are dissatisfied with the refusal of a permit you have the right to appeal to the Secretary of State.
