The application by Basingstoke and Deane Borough Council and Hampshire County Council to the High Court for a final injunction against the setting up of unauthorised encampments within the urbanised area of Basingstoke town, as well as the outlying areas of Bramley, Silchester, Tadley Common and a small parcel of land at Stratfield Turgis was granted on Thursday 4 April 2019. The injunction includes provision for powers of arrest and will be in place for a period of five years.
An interim injunction was granted on 30 July 2018 to prevent unauthorised encampments in a 26 square mile area of Basingstoke.
Following an application for a similar injunction to the High Court by another local authority, all 37 injunctions granted to local authorities have been reviewed by the High Court who ruled that the part related to ‘persons unknown’ should be discharged. A total of 16 councils – including Basingstoke and Deane Borough Council – have applied to courts to appeal this decision.
The documents in support of the extended area and finalising the injunction are accessible below or can be viewed by calling the council on 01256 844844 and asking to speak to the Environmental Health Duty Officer to arrange appointment.
