Injunctions

Unauthorised encampments within the urbanised area of Basingstoke town, as well as the outlying areas of Bramley, Silchester, Tadley Common and a small parcel of land at Stratfield Turgis

Basingstoke and Deane Borough Council and Hampshire County Council were granted an injunction by the High Court against the setting up of unauthorised encampments within the urbanised area of Basingstoke town, as well as the outlying areas of Bramley, Silchester, Tadley Common and a small parcel of land at Stratfield Turgis on Thursday 3 April 2019.

This injunction, which applies to already identified people and new people setting up unauthorised encampments within these areas for five years, has significantly reduced the number of unauthorised encampments in the borough and the associated clear up costs.

Following an application for a similar injunction to the High Court by the London Borough of Enfield, all 37 injunctions granted to local authorities have been reviewed by the High Court. A total of 16 councils – including Basingstoke and Deane Borough Council – appealed the points raised by the review, most specifically the application of the injunction to new, non-identified people setting up unauthorised encampments within the injunction area.

On Thursday 13 January 2022 the Court of Appeal allowed the appeal, meaning that the injunction remains in place to include both identified people as well as unidentified people.

Silchester (land adjacent to and rear of Culhams Mill, Little London Road) to a residential caravan site for travellers

The council was granted an interim injunction on Tuesday 21 February at the High Court. This injunction prevents any further tree removal, laying of hardstanding, bringing onto the land of any other building materials, further caravans, mobile homes or buildings and any other construction work on the land adjacent to and rear of Culhams Mill, Little London Road in Silchester.

The injunction was served at the site on the evening of Tuesday 21 February and will remain in place. A planning application was subsequently submitted and refused. An Enforcement Notice was served following following the decision to refuse the planning application. An appeal was submitted against the service of an Enforcement Notice and we are currently awaiting a date for a Public Enquiry regarding when this will take place.
